Terms and conditions
Please read this Visitor Agreement published by Mambo Publishing Company Ltd, United Kingdom, the owners of mambomagazine.com, henceforth referred to as MPC.
By using any websites published by MPC, you accept the company's terms and conditions. You agree to use these sites only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use of the site by any third party.
We may change the terms of this Visitor Agreement from time to time. By continuing to use MPC sites after we post any such changes, you accept this Visitor Agreement, as modified. We may change, restrict access to, suspend or discontinue the site, or any portion of the site, at any time. MPC respects the privacy of its site users. Please take a few minutes to review our Privacy Policy.
If you disagree with any material you find on MPC sites, we recommend that you respond by noting your disagreement in an appropriate site forum where there is one. We also invite you to bring to our attention any material you believe to be factually inaccurate.
The material that appears on MPC sites is for informational and entertainment purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before you act on information you've found on MPC sites, you should confirm any facts that are important to your decision. MPC sites and their information providers make no warranty as to the reliability, accuracy, timeliness, usefulness or completeness of the information on the sites.
MPC is not responsible for, and cannot guarantee the performance of, goods and services provided by our advertisers or others to whose sites we link. A link to another website does not constitute an endorsement of that site (nor of any product, service or other material offered on that site) by MPC or its staff.
MPC does not guarantee that its sites, or the servers that makes them available, are free of viruses or bugs or represent the full functionality, accuracy and reliability of the materials. Any loss incurred or sustained by the user when transmitting information by means of email or other internet links shall be borne solely and exclusively by you and in no event shall any such loss in whole or in part be borne by MPC.
WRITTEN SUBMISSIONS
If you wish to submit content ideas for mambomagazine.com, please read our Submission Guidelines. There is no guarantee that we can respond to unsolicited submissions.
COPYRIGHT
Users warrant that submissions to MPC sites do not infringe upon any copyright, trademark or other intellectual property rights worldwide of other persons or companies. All content including links, documentation, files and images will be in the public domain once added to MPC sites. It is the user's responsibility to ensure these files comply with copyright laws and any content legislation.
By submitting material to MPC sites or staff, you are representing that you are the owner of the material, or are making your submission with the express consent of the owner. You also warrant that all moral rights in any material that you submit to us have been waived. Submitting material that is the property of another, without the consent of its owner, is not only a violation of this Visitor Agreement, but may also subject you to legal liability for infringement of copyright, trademark or other intellectual property rights.
If you believe that your copyright has been infringed, then please contact us at enquiries [at] mambomagazine [dot] com with:
- identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
- information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number and an electronic mail address at which the complaining party may be contacted.
MPC will, once contacted, endeavour to remove any such material forthwith until the issue of copyright ownership has been resolved.
If you are a contributor to mambomagazine.com, MPC retains the rights to publish your work throughout that site in an editorial context, and to replicate submissions in more than one place on the site, but not to use your work in advertisements or to sell your work on to third-party clients – rights to your material beyond mambomagazine.com and mamboconsultancy.com, where your work may appear for illustrative purposes, remain with you.
FORUMS AND COMMENTS
MPC wishes to promote an open exchange of information and ideas. Staff aim to moderate comments made by anonymous users or unregistered users on MPC forums and articles, but we cannot and do not review every posting made in public posting areas and you can expect these areas to include content, information and opinions from a variety of individuals and organisations other than MPC.
We do not endorse or guarantee the accuracy of any posting, regardless of whether the posting comes from a user, from a guest poster, or from a member of MPC staff.
Responsibility for what is posted in public posting areas on MPC sites lies with each user - you alone are responsible for material you post. By using MPC sites, you agree not to post or transmit any libellous, defamatory, abusive, obscene, pornographic, threatening or illegal material, or any other material that infringes on the ability of others to enjoy the site or that infringes on the rights of others.
You may not permit any person to access, using your account, any features of MPC sites that require registration. You may not post a single message to more than two areas of a single MPC site, or post any message to any area of an MPC site if that message is, in our view, off-topic or in violation of this Visitor Agreement. We retain the right to deny access to anyone who we believe in our sole discretion has violated these terms or any other term of this Visitor Agreement.
Although MPC cannot monitor all the postings in site forums and other public posting areas, we reserve the right (but assume no obligation) to delete, move or edit any postings, including without limitation any content submissions that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons.
MPC reserves the right to terminate any user's access to registered areas of the MPC sites at its discretion
NO SOLICITING
You agree not to use MPC sites to advertise, or to solicit anyone to buy or sell, products or services, nor to solicit anyone to make donations of any kind, without express written approval from MPC. The exception to this rule is the bulletin board on mambomagazine.com, where users may submit small classified posts concerning the sale of personal items or advertising events and local businesses relevant to the Zanzibar archipelago or the wider East African region. The advertisement of services not relevant to this region is not permitted, and neither are spam advertisements for pharmaceuticals or pornographic sites.
NO SPAMMING
From time to time, users post their email addresses in MPC forums and other public posting areas. You may not gather these email addresses for commercial or illegal purposes, such as sending unsolicited or unrequested email or instant messages.
NO FRAMING
Without written permission from MPC, you may not frame, or make it appear that a third-party site is presenting or endorsing, any of the content of any MPC sites, or incorporate any intellectual property of MPC sites into another website or service.
MAMBO SERVICES
MPC reserves the right to vary the provision of services listed on its sites without notice. All services are subject to availability and MPC reserves the right to refuse to supply services.
BOOKING TRAVEL
The travel booking features of MPC sites are provided in order to help users to locate available travel-related services and to make legitimate reservations or otherwise transact business with suppliers. Once a user has submitted a search request for travel services, he/she will leave MPC sites. As such, separate terms and conditions will apply to any reservation and purchase of the travel-related services that users may select, and users should look for them prior to booking travel.
FINALLY
MPC shall not be held to be in breach of its obligations hereunder nor liable to you for any loss or damage which may be suffered by you or any third party due to any clause beyond reasonable control. In no event will MPC be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use of or in connection with such use or loss of use of the site, whether in contract or in negligence.
